§ 7-7-105. Activity reports by lobbyists.
   (a)   Activity reports required. Each lobbyist shall file with the Ethics Commission an activity report on or before May 31 for the preceding November 1 through April 30, and on or before November 30 for the preceding May 1 through October 31 in which the lobbying activities were conducted. If the lobbyist is not an individual, an authorized officer or agent shall sign the report. A separate activity report shall be filed for each person on whose behalf the lobbyist acts.
   (b)   Information required. The report shall be under oath and notarized, and shall include the following information:
      (1)   a complete and current statement of the information required to be supplied under § 7-7-102(c);
      (2)   total expenditures on acts requiring registration in each of the following categories:
         (i)   total compensation paid to the lobbyist, with prorated amounts labeled as such, excluding expenses reported under subsection (b)(2)(ii) through (b)(2)(viii);
         (ii)   office expenses of the lobbyist not reported in subsection (b)(2)(i) including salaries, compensation, and reimbursed expenses for the staff of the lobbyist;
         (iii)   the amount paid for professional and technical research and assistance not reported in subsection (b)(2)(i);
         (iv)   the amount paid for publications that expressly encourage persons to communicate with employees;
         (v)   the names of witnesses and the fees and expenses paid to each;
         (vi)   the amount paid for meals and beverages for employees or their immediate families;
         (vii)   the amount paid for special events, including parties, dinners, athletic events, entertainment, and other functions to which any employee was invited;
         (viii)   the expenses paid for food, lodging, and scheduled entertainment of employees who attended a meeting and were provided in return for participation in a panel or speaking engagement at the meeting;
         (ix)   the amount paid for other gifts, including their itemized description, to or for employees and their immediate families; and
         (x)   the amount paid for other expenses, including their itemized description; and
      (3)   (i)   the name of each employee, or member of the employee's immediate family, who has benefited from gifts with a cumulative value of $50 or more during the reporting period, given by the lobbyist or anyone acting on behalf of the lobbyist, whether or not the gifts were given in connection with the lobbying activities.
         (ii)   if the cumulative value of $50 is attained or exceeded, each gift shall be itemized by date, beneficiary, value, and nature of the gift.
   (c)   Proration of compensation. If lobbying is only a portion of a person's employment, compensation shall be determined by a prorated amount based on time devoted to lobbying compared to the time devoted to other employment duties.
   (d)   Allocation of expenses. Expenses reported in subsection (b) shall be allocated to individual employees, and for each such expenditure, the date, location, and total expenses incurred by the lobbyist shall be stated.
   (e)   Additional or supplementary reports. The Ethics Commission may require any lobbyist to file additional or supplementary reports as the Ethics Commission considers necessary and specifies in writing to the lobbyist.
