(a) Generally. If, while considering a complaint or during any investigation or inquiry, the Ethics Commission finds that there are reasonable grounds to believe that the respondent may have committed a criminal offense, the Ethics Commission shall refer the matter promptly to an appropriate prosecuting authority.
(b) Evidence to be available. The Ethics Commission shall make all evidence within its control available to the Prosecuting Authority.
