§ 6-1-301. Holidays.
   (a)   Recognized holidays. Except as otherwise provided in this section, full-time employees in the classified service are entitled to holiday leave for the following holidays:
      (1)   New Year's Day (January 1);
      (2)   Dr. Martin Luther King, Jr.'s Birthday (third Monday in January);
      (3)   Washington's Birthday (third Monday in February);
      (4)   Good Friday;
      (5)   Memorial Day (last Monday in May);
      (6)    Juneteenth (June 19);
      (7)   Independence Day (July 4);
      (8)   Labor Day (first Monday in September);
      (9)   Veteran’s Day (November 11);
      (10)   Thanksgiving Day;
      (11)   Thanksgiving Friday;
      (12)   Christmas Day (December 25);
      (13)   the days of general and congressional elections, not including primary elections, throughout the State; and
      (14)   the days that are designated as legal holidays for State employees by the Governor and that are approved by the County Executive.
   (b)   Classified employees who are required to work on holidays. Except as otherwise provided in a memorandum of agreement negotiated and signed under Title 4 between the County and an exclusive representative, employees in the classified positions identified by the Personnel Officer as regularly required to work on holidays shall receive 16 additional days of annual leave each year instead of holidays.
   (c)   Holidays falling on weekends or on regularly assigned day off. If a legal holiday falls on a Sunday, the Monday next following shall be a holiday. If a legal holiday falls on a Saturday, the Friday preceding shall be a holiday. If a legal holiday falls on the regularly assigned day off, the employee is entitled to appropriate time off with pay.
   (d)   Holidays occurring during approved leave. Holidays that occur during a period of approved leave are not charged as leave.
   (e)   Rate of pay. An employee shall be paid the employee's regular rate of pay for each holiday unless the employee is on an unauthorized leave of absence or on disciplinary suspension on the employee's regularly scheduled work day immediately before or after the holiday. An employee on disability leave probation who takes disability leave on the employee's regularly scheduled work day immediately before or after a holiday is considered to take an unauthorized leave of absence unless the Personnel Officer approved the disability leave based on extenuating circumstances.
   (f)   Part-time employees. Part-time employees who work at least 50% of the normal work week are entitled to a prorated amount of additional annual leave instead of holidays. An appointing authority may require the use of the annual leave on the County holiday that generates the leave if the holiday occurs on the part-time employee's regularly scheduled work day.
