§ 6-1-204. Pay advancement through range, performance pay awards – Non-represented employees.
   (a)   Applicability. This section applies to all employees in the classified service who are not represented by a certified employee organization.
   (b)   Award of increases. The appointing authority may award increases in pay to an employee at intervals no more frequently than once every fiscal year if the employee has completed the employee's probationary period, exclusive of any increase awarded under subsection (e).
   (c)   Maximum increase. For an employee who is not at the maximum pay of the employee's pay range the amount of the pay increase may not exceed 10% of the pay that the employee is receiving at the time of the increase, exclusive of any increase awarded under subsection (e), and may not exceed the maximum pay for the grade.
   (d)   Performance pay award. An appointing authority may make a performance pay award to any employee who is at or above the maximum of the employee's pay range and who has, in the previous rating period, significantly and consistently exceeded expectations.
   (e)   Legislative Auditors' pay increase. An employee on the LA pay schedule who obtains a license in the State of Maryland as certified public accountant and who was not licensed in the State of Maryland or any other state when the employee was first hired to a position on the LA pay schedule is entitled to a 5% increase in pay beginning the first pay period after obtaining a license as a certified public accountant in the State of Maryland, not to exceed the maximum pay for the employee's current grade.
   (f)   Maximum increase with performance pay award. The amount of the performance pay award and any increases under subsections (c) and (d) combined may not exceed 10% of the pay that the employee was receiving prior to the time of the award and increase.
   (g)   Effect on designated base pay. A performance pay award made under subsection (d) does not increase the designated base pay of an employee.
