§ 5-2-105. Board of Trustees – Membership.
   (a)   Generally. The Board consists of the following 13 Trustees:
      (1)   the Chief Administrative Officer, ex officio;
      (2)   the Controller, ex officio;
      (3)   the Personnel Officer, ex officio;
      (4)   the Budget Officer, ex officio;
      (5)   the Director of Public Works, or other appointed official of the County as appointed by the County Executive, ex officio;
      (6)   five Trustees:
         (i)   one of whom is a participant in the Fire Service Retirement Plan;
         (ii)   one of whom is a participant in the Police Service Retirement Plan and a member of FOP Lodge 70;
         (iii)   one of whom is a participant in the Detention Officers' and Deputy Sheriffs' Retirement Plan;
         (iv)   one of whom is a participant in the Employees' Retirement Plan and a member of either Local 582 or Local 2563 of the American Federation of State, County, and Municipal Employees AFL-CIO (affiliated with Maryland Public Employees' Council 67); and
         (v)   one of whom is a participant in the Employees' Retirement Plan and is not a member of a certified employee organization; and
      (7)   three Trustees who are residents of the County, are not employees of the County or participants in any of the plans, and are knowledgeable in the administration and operation of pension systems and trust funds.
   (b)   Trustee not to be member of Pension Oversight Commission. A Trustee may not serve simultaneously as a member of the Board and a member of the Pension Oversight Commission.
   (c)   Election of Trustees. The Trustees who are described in subsection (a)(6)(i), (ii), and (iii) shall be elected severally by the employees who are included within the plan that each Trustee represents. The Trustee who is described in subsection (a)(6)(iv) shall be elected by the employees of the County who are members of either (1) Local 582 or Local 2563 of the American Federation of State, County, and Municipal Employees AFL-CIO (affiliated with Maryland Public Employees' Council 67) or (2) another certified employee organization, and who are not participants in the Fire Service Retirement Plan, the Police Service Retirement Plan, or the Detention Officers' and Deputy Sheriffs' Retirement Plan. The Trustee who is described in subsection (a)(6)(v) shall be elected severally by the employees of the County who are not represented by a certified employee organization, and the election shall be by secret ballot and supervised by the Personnel Officer. The Trustees who are described in subsection (a)(7) shall be appointed by the County Executive with the approval of the County Council, given by resolution.
   (d)   Oath of office. Within 10 days after the appointment or election of an individual as a Trustee, or, in the case of a Trustee who serves ex officio, within 10 days after the effective date of Bill No. 88-96, the individual shall take and subscribe to an oath of office that, so far as it devolves on an individual as a Trustee, the individual will diligently and honestly administer the affairs of the Board and will not knowingly violate or willingly allow a violation of the law applicable to the plans. The oath shall be taken before a notary public who shall certify the oath and submit the certified oath to the Chief of Staff to the County Executive for filing in that office.
   (e)   Terms. The terms of the Trustees described in subsections (a)(6) and (a)(7) are three years. A Trustee described in subsection (a)(6) who becomes a retiree during the Trustee's term of office may complete that term of office. At the end of a term, a Trustee continues to serve until a successor is appointed or elected and a Trustee described in subsections (a)(6) and (a)(7) who is newly appointed or elected shall serve a new three-year term that commences with the Trustee's qualification under subsection (d).
   (f)   Removal by County Executive. As provided in subsection (g), the County Executive may remove a Trustee for neglect of duty, misconduct in office, any other conduct that renders the Trustee unfit for office as described by ordinance, or any change in status that renders the person ineligible under this section.
   (g)   Removal for cause. The County Executive may remove for cause a Trustee who is described in subsection (a)(6) or (a)(7).
