§ 5-1-305. Transferred service "window".
   (a)   Transfer not allowed on or after March 5, 2001. Except as otherwise provided in this section, a participant in the Fire Service Retirement Plan or Police Service Retirement Plan may not transfer service credit to the plan under the State Personnel and Pensions Article, Title 37, of the State Code, on or after March 5, 2001.
   (b)   Transfer allowed if employed from July 1, 1990 to December 3, 1996. A participant in the Fire Service Retirement Plan or the Police Service Retirement Plan who began employment with the County in a position covered by the Fire Service Retirement Plan or the Police Service Retirement Plan at any time during the period from July 1, 1990 to December 31, 1996 may receive transferred service for service transferred from another state or local retirement or pension system for a period of employment by the State or a political subdivision of the State other than this County, provided:
      (1)   the previous system was operated on an actuarial basis, with contributions to the System that were computed to be sufficient to provide the reserves needed to cover the benefits payable on account of the System's members and made during the employment of the members;
      (2)   the participant did not incur a break in employment between the employment by the State or a political subdivision of the State other than this County for which credited service is claimed and the employment by the County in a position covered by the plan;
      (3)   the participant previously has not received credited service under the plan for the service to be transferred;
      (4)   the participant is actively employed by this County in a position covered by the plan at the time of making a claim for the credited service;
      (5)   the participant makes a claim for the credited service no later than 45 days after receiving the notice described in subsection (c);
      (6)   if the transfer is from a contributory plan, the participant deposits into the pension fund the total accumulated contributions to the participant's credit in the fund of the previous system no later than 30 days after receiving notice from the Personnel Officer that the transfer has been approved; and
      (7)   except as otherwise provided in this section, the transfer of credited service satisfies the requirements of the State Personnel and Pensions Article, Title 37, of the State Code.
   (c)   Notice of right to make claims. The Personnel Officer shall notify all participants in the Fire Service Retirement Plan or the Police Service Retirement Plan of their right to make claims for transferred service under this section.
   (d)   No transfers on or after January 1, 1997. Notwithstanding any other provision of this subtitle, a participant in the Fire Service Retirement Plan or the Police Service Retirement Plan may not transfer service credit to the plan under the State Personnel and Pensions Article, Title 37, of the State Code, for service with the State or a political subdivision of the State that occurred on or after January 1, 1997.
