(a) Definition. In this section, "Board" means a Disability Pension Review Board.
(b) Boards established. There is a Disability Retirement Pension Review Board for each plan under this article.
(c) Members. Each Board consists of five members. Of the five members, two shall be active participants of the plan; one shall be an attorney from the Office of Law; one shall be an employee from the Office of Personnel; and one shall be a physician licensed to practice in this State. The County Executive shall appoint the members and select a Chair from among the members. Each member shall serve a two-year term.
(d) Vacancy. If a vacancy occurs during the term of any member, the County Executive shall appoint a qualified successor to complete the unexpired balance of the term.
(e) Quorum. At a meeting or hearing conducted by a Board, the presence of three members constitutes a quorum.
(f) Compensation. A member who is also a County employee is not entitled to remuneration for services except for reimbursement for reasonable and necessary expenses provided in the budget. Compensation of the member who is a physician shall be fixed by the Personnel Officer subject to budget limitations.
(g) Board review and evaluation. On application of a participant, a Board shall review and evaluate the initial denial of a disability retirement pension claim by the Personnel Officer. The conclusions and recommendations of the Board shall be transmitted to the Personnel Officer and are advisory only. Following receipt of the Board's advisory recommendation, the Personnel Officer shall make a final decision.
(h) Board rules and regulations. Each Board shall adopt rules and regulations governing its review and hearing of cases. Before taking effect the rules and regulations shall be approved by the Personnel Officer.
