(a) Composition.
(1) The Authority consists of nine members appointed by the County Executive.
(2) Each of the members shall be a resident of Anne Arundel County; an individual of integrity who has demonstrated abilities in business and public affairs based on education or relevant experience; and selected without regard to the member's representation of or support for any special interest.
(3) Neither the member nor the member's grandfather, grandmother, father, mother, son, daughter, stepson, stepdaughter, grandson, granddaughter, brother, sister, uncle, aunt, niece, or nephew, or the spouse of any of them, may have a financial interest in any project with respect to which the Authority has jurisdiction or any power or authorization to act.
(4) A member may not be a County elected official, County appointed official, or County employee.
(5) The Director of Public Works or the Director's designee shall serve as a non-voting adviser to the Authority.
(b) Oath of office. Before undertaking the duties of a member, each member of the Authority shall take a constitutional oath of office before the Clerk of the Circuit Court for Anne Arundel County.
(c) Term of office. The term of a member is five years. The terms of members are staggered so that of the initial members, the term of at least one member, but not more than two members, ends on December 31 of each of the five years following establishment of the Authority. At the end of a term, a member continues to serve until a successor is appointed and qualifies. A member who is appointed after a term has begun serves only for the rest of the term and until a successor is appointed and qualifies. A member may be reappointed.
(d) Removal of members.
(1) A member of the Authority may be removed by the County Executive for cause, including absence from 25% or more of the scheduled meetings and hearings of the Authority during any 12-month period.
(2) The Chair of the Authority shall:
(i) notify the County Executive of any member who is absent from 25% or more of the scheduled meetings and hearings during any 12-month period;
(ii) include in the notification any known extenuating circumstances; and
(iii) send a copy of the notification to each member of the Authority.
(3) The County Executive may excuse the absences for good cause such as illness, emergency situations, or other extenuating circumstances.
