(a) Established. There is a Self-Insurance Fund Committee.
(b) Membership. The Committee consists of the Chief Administrative Officer, the County Attorney, the Central Services Officer, the Controller, a member of the Board of Trustees of the Public Library Association of Annapolis and Anne Arundel County, Inc., a member of the Board of Trustees of Anne Arundel Community College, and a member of the Board of Education, or their respective designees. Annually, the Committee shall elect a Chair from among its members.
(c) Approval of decisions. Each decision made by the Committee shall be approved by at least three of its members, except that review and approval of all claims for payment from the Fund that are $100,000 or greater shall include participation and vote for approval by at least four of the total members. Any member of the Committee with a direct personal interest in the claim may not participate in or vote on the decision to settle the claim.
(d) Duties. The Committee shall:
(1) review and approve all claims for payment from the Fund for property damage and automobile liability where the amount to be paid exceeds $25,000 but is less than $100,000;
(2) review and approve all claims for payment from the Fund for general liability and settlements of workers' compensation claims where the amount to be paid exceeds $25,000 but is less than $100,000;
(3) review and conditionally approve and submit to the County Council for final approval by resolution all claims for payment from the fund that are $100,000 or greater;
(4) establish policies relating to the operation and maintenance of the Fund; and
(5) adopt rules and regulations necessary for the operation of the Fund, including rules to establish the nature of losses to be paid from the Fund, the limits of liability payable from the Fund if not otherwise provided by law, and the nature of administrative expenses to be paid by the Fund if not otherwise provided by law.
(e) Adoption of rules. The Committee may adopt rules for the conduct of its business.
