(a) Considerations. In designating a road as scenic or historic, the Commission shall consider;
(1) the visual quality of the road itself and its right-of-way, and the view from the roadside and the environment through which the road passes; and
(2) the historic significance of the road, its right-of-way, or the bordering land.
(b) Criteria for designation. For designation as a scenic or historic road, a road shall meet at least two of the criteria set forth in this section.
(c) Specific criteria. A scenic or historic rural road shall:
(1) have outstanding natural features along its right-of-way or borders;
(2) have outstanding vistas of rural landscape;
(3) have historic significance or be a component of a historic landscape;
(4) have low traffic volume, with the road designed primarily for local use;
(5) be narrow, without sidewalks, curbs, or gutters;
(6) have a winding horizontal or undulating vertical alignment, with steep side embankments; or
(7) have integrity and the ability to convey its significance.
(d) Requirements. A scenic or historic neighborhood road shall:
(1) have a scale compatible with the neighborhood;
(2) have alignments that are integrated with the natural and created features of the neighborhood;
(3) have views of historic resources, pass through neighborhoods containing historic buildings, or possess its own historic significance;
(4) have integrity and the ability to convey its significance; or
(5) be part of a network of like roads that together create a cohesive neighborhood.
