(A) On or about July 1, 1996, the village caused a report to be used in connection with the development of a Wellhead Protection Plan to be prepared by the firm of Panterra Corporation.
(B) The village on or about May 1999, in reliance on the report, developed and prepared a Wellhead Protection Plan, including a management component, drinking water contingency plan, and sample siting plan.
(C) The village has submitted the plan to the Ohio Environmental Protection Agency (OEPA) for approval and endorsement of the protective strategies for the village’s drinking water source, all as set forth in the plan.
(D) On September 5, 2000, the OEPA informed the village that OEPA approves and endorses the protective strategies of the plan (“approval letter”).
(E) The village hereby adopts the Plan for implementation based upon the approval letter.
(F) The Village Administrator is authorized and directed to proceed with the implementation of the Plan as necessary.
