94.06 SEWER CONNECTION DISTRICTS ESTABLISHED.
The following sewer connection districts have been established and all connection requirements provided in this chapter shall apply.
1.   Seasons Ridge Sanitary Sewer Connection District I.
   A.   The “Seasons Ridge Sanitary Sewer Connection District I” means and includes only the following described real estate:
      (1)   “Seasons Ridge Sanitary Sewer Extension I” means the sanitary sewer installed along and adjacent to Golfview Acres Plats 3 and 5, official plats now included in and forming a part of the City.
      (2)   “Seasons Ridge Sanitary Sewer Connection District I” means and includes only the following described real estate:
Lots 1, 2, 3, 4, 5, 6, 7, 8, 9 and 15 in Golfview Acres Plat 3, an official plat now included in and forming a part of the City; and
Lots 1, 2, 3, 4 and 5 in Golfview Acres Plat 5, an official plat now included in and forming a part of the City.
   B.   The owner of any lot included within the Seasons Ridge Sanitary Sewer Connection District I desiring to make a service connection to the Seasons Ridge Sanitary Sewer Extension I shall pay a connection fee to the City in the amount of $2,000.00 for the right of make such connection. Such fee is in lieu of, and not in addition to, the fees set forth in Section 94.04, subsections 1 through 4. In the event any such lot is subdivided and additional residential structures are permitted thereon, the owner of each such structure shall be required to pay an additional $2,000.00 fee.
   C.   Nothing in this section is intended to preclude future further extensions, by the City or upon approval of the City, of the Seasons Ridge Sanitary Sewer Extension for the purpose of providing sanitary sewer service to property other than property included in the Seasons Ridge Sanitary Sewer Connection District I. It is the intent of this section that, whether or not the Seasons Ridge Sanitary Sewer Extension is hereafter further extended, no direct service connections shall be made to that portion of the Seasons Ridge Sanitary Sewer Extension defined hereunder as the Seasons Ridge Sanitary Sewer Extension I except as provided for hereunder.
2.   Oralabor Road Trunk Sewer Connection District 1.
   A.   For the purposes of this section, the following terms have the following meanings:
      (1)   “Oralabor Road Trunk Sewer Project” means the eighteen-inch diameter and twelve-inch diameter gravity trunk sewer extending from the WRA Four Mile Interceptor Extension sewer north of SE Oralabor Road (County NE 78 th Avenue) northwesterly under SE Four Mile Drive (County NE 29 th Street) to a point near the north line of the SE¼ SE¼ of Section 30 Township 80 North Range 23 West of the 5 th P.M.
      (2)   “Oralabor Road Trunk Sewer Connection District 1” means and includes only the following described real estate:

   B.   The owners of residences on parcels of less than one acre in size may connect such residences to the Oralabor Road Lift Station and Trunk Sewer Project upon approval of their application for connection, approval of the size of the connection, and payment of a connection fee in the amount of $2,600.00 to the City. Such fee is in lieu of, and not in addition to, the fees set forth in Section 94.04, subsections 1 through 4.
   C.   The owners of residences on parcels in excess of one acre in size may connect such residences to the Oralabor Road Lift Station and Trunk Sewer Project upon payment of a connection fee in the amount of $2,600.00 per acre. However, the owner may divide said parcel into a residence parcel of no more than one acre and a remainder parcel, and pay the connection fee in the amount of $2,600.00 for the residence parcel. The connection fee for the remainder parcel shall be payable at such time as the remainder parcel shall be connected to the Oralabor Road Lift Station and Trunk Sewer Project. For purposes of this section, division of the property into a residence parcel and a remainder parcel may be accomplished by submitting a drawing showing a graphical depiction of the two parcels including dimensions accurate to within a distance of one foot, a legal description of the entire parcel and a legal description of the residence parcel with such accuracy as to allow the City to determine a reasonable description of the remainder parcel. For purposes of this section, the division of property does not require a subdivision of the property or a plat of survey.
   D.   In the event any parcel within the Oralabor Road Lift Station and Trunk Sewer Connection District I is developed for industrial or commercial use, or is subdivided and additional structures are permitted thereon, the owner or developer of the parcel shall be required to pay the fee for the right to make connections to the Oralabor Road Trunk Sewer or extensions of sewer mains connected to the Oralabor Road Trunk Sewer as necessary for their development. The fee will be paid prior to the connection, in the case of service connections to industrial or commercial buildings, or prior to City approval of construction contracts for a sewer main extension to serve a subdivision. The fee is determined at a rate of $2,600.00 per acre for the entire parcel being developed or subdivided.
   E.   Nothing in this section is intended to preclude future further extensions, by the City or upon approval of the City, of the Oralabor Road Trunk Sewer or sewer mains connected to the Oralabor Road trunk sewer, or sewer mains connected to the Oralabor Road lift station for the purpose of providing sanitary sewer service to property other than established parcels included in the Oralabor Road Lift Station and Trunk Sewer Connection District I. It is the intent of this section that, whether or not the Oralabor Road Trunk Sewer is hereafter further extended, no connections shall be made to that Oralabor Road Lift Station and Trunk Sewer Project or extension except as provided for hereunder.
3.   Rock Creek Trunk Sewer Connection District 1.
   A.   The “Rock Creek Trunk Sewer Connection District 1” means and includes only the following described real estate:
