(A) The Clerk-Treasurer’s office shall furnish an application to any individual desiring to utilize temporary housing for a time interval greater than 30 days. Each applicant must:
(1) Have the temporary housing inspected by the Town Utility Superintendent who shall indicate whether it is suitable for connection to the town’s utilities;
(2) Have the temporary housing inspected by the Building Commissioner, or the commissioner’s designee, who shall indicate whether it is suitable for human occupancy for up to 180 days and if there are any limitations to such occupancy; and
(3) Have the temporary housing inspected by the Health Officer, or the officer’s designee, who shall indicate whether it is suitable for human occupancy for up to 180 days and if there are any limitations to such occupancy;
(4) Return the completed application with the signatures of the individuals identified above to the Clerk-Treasurer’s office;
(5) Pay the permit application fee of $50; and
(6) Attend the next regularly-scheduled meeting of the Council to answer any questions concerning the application.
(B) The completed application shall be added to the agenda for consideration by the Council at the next regularly-scheduled meeting.
(C) Council, in its sole discretion, shall consider the completed application and grant or deny the applicant a permit to utilize the temporary housing for up to 180 days for human occupancy on the parcel identified on the application. In determining whether to grant or deny an application for permit, Council may consider any factors it deems relevant including, but not limited to, the following: whether the unit is self-propelled or a tow-behind; its model year; its interior square footage; whether it has a restroom with a bath or shower; the number of occupants to reside in the unit; whether any pets will reside with the occupant and, it so, the number and breed of the animals; whether the unit is factory designed and factory built; and/or the occurrence of nuisance or other code violations at the subject property.
(D) An individual may submit a written request to the Clerk-Treasurer for Council’s consideration to renew the permit for one additional interval of 180 days without having to complete a new application. Council, in its sole discretion, may grant or deny a renewal of the permit to utilize the temporary housing for one additional 180 day period after considering factors including but not limited to: any changes to the condition of the temporary housing. the occurrence of nuisance or other code violations at the subject property, and the current status of the utility services account for the subject property.
(E) The permit to occupy a temporary housing shall be limited to one such unit per parcel.
(F) Upon expiration of the permit and any renewal, the temporary housing shall be removed from the property.
