(A) No person shall deface, remove, alter or possess property belonging to another person without the express consent of the owner of the property.
(B) During the period from October 1 through October 31, no person under the full age of 18 years shall be present upon a public street or in any public place between the hours of 9:00 p.m. and 5:00 a.m. unless accompanied by a parent or guardian or unless the person’s presence on a public street shall be occasioned by his or her lawful employment or he or she be in attendance or in route to or from a school, church or community service; provided that nothing herein shall be construed to prevent a parent or guardian from conducting properly supervised activities in private homes where one or more parents or guardians of children in attendance is present.
(C) No person shall enter upon any premises or property for the purpose of engaging in the practice known as “trick or treating” except on dates so designated by the Town Council, and then only between the hours of 6:00 p.m. and 9:00 p.m.
(D) It is the policy of the town that the parent or guardian of any person who shall violate division (A) above shall respond in damages to the owner of the property affected, and to this end all police of the town are directed and encouraged to assist in civil actions in which damages are sought for the violation of division (A) above.

(A) As used in this section, CONTAINER has the meaning set forth in I.C. § 7.1-1-3-13.
(B) No person shall possess a container:
(1) That has been opened;
(2) That has a broken seal;
(3) From which some of the contents have been removed; or
(4) In a public right-of-way, street, highway, alley, park or other state, county or municipal property, except as otherwise permitted pursuant to a permit issued by the Indiana Alcohol and Tobacco Commission.

(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(C) Any person, firm or corporation found guilty of the violation of § 130.06 shall be fined in any sum not exceeding $100 or 30 days in jail or both. Each violation of this section shall be deemed to constitute a separate offense.

(E) For violating the provisions of § 130.08 of this chapter, a citation shall issue to the offender and the fine for the first offense shall be $100; for the second offense the fine shall be $200; and for all subsequent offenses the fine shall be $300.
