(A) In order that the single-family domestic and residential users of sewage service shall not be penalized for sprinkling lawns during the summer months of May, June, July, and August, such customers may apply for a Summer Sprinkling Credit. In the month of April of each calendar year, a single-family domestic or residential customer, who has been a customer of the town water utility continuously from January 1 of that year and is not delinquent in the payment of any of the rates and charges of that water utility at the time of application may apply, on an application available from the Town Clerk-Treasurer for that purpose, for a prospective summer sprinkling credit for any or all of the next four (May, June, July, and August) utility billing periods.
(B) Upon approval of the application, the applicant shall have the summer sprinkling credit code activated in the utility software by the Clerk-Treasurer’s office. The program will take the total consumption of the accumulation months (February, March, and April) and divide that total accumulation by the number of months (three) for the comparison months. In the comparison months (May, June, July, and August), if a customer has used over the accumulated consumption average, they will be charged that amount for the water used, but for the sewer portion of the bill they will be charged for the amount of the accumulated consumption average.
(1) The Clerk-Treasurer must be reasonably satisfied that the additional metered water almost certainly will not be discharged into the town’s wastewater collection and treatment system.
(2) The determination by the Clerk-Treasurer as to the potential for discharge into the wastewater system may be appealed in writing by the applicant to the Town Council, within 20 days of the issuance by the town of the billing being appealed. Determinations of Council shall be final.
(3) Special circumstances and exceptions to this section may be appealed to the Town Council. Determinations of Council shall be final.
(C) The determination by the Clerk-Treasurer as to the potential for discharge into the wastewater system may be appealed in writing by the applicant to the Town Council, within 20 days of the issuance by the town of the billing being appealed.
(D) A wastewater customer will be allowed a wastewater-only billing adjustment one time per calendar year for a swimming pool fill which occurs during the months of May, June, July or August of that year only when, and on condition that, an express written request for the adjustment is submitted to the Town Clerk-Treasurer within ten business days after that swimming pool fill. That adjustment shall reduce the wastewater portion of the customer’s bill for the monthly billing period in which the fill took place to a billing for that customer’s average monthly wastewater volume billed for in the immediately preceding three wastewater billing periods. This adjustment is separate from and shall not be duplicated, in whole or in part, by a wastewater billing credit under division (A) above.
