When a fine is the whole or part of a sentence the Mayor's Court may order the person sentenced to remain confined in the County jail or workhouse or in the prison of the City until the fine is paid, or secured to be paid, or the offender is legally discharged, provided that nonpayment is not the result of the defendant's inability to pay.
