1353.04 ENTRY AND INSPECTION.
   (a)    Inspections must be made in all instances of change of ownership or change of rental tenants as determined by requests to the Department of Public Service for utility services or in any other instance at the discretion of the Building Inspector. However, subject to the limitations of the Constitution of the United States and the State of Ohio, and in order to carry out the purpose and provisions of this Housing Code, the Building Inspector and Fire Chief are hereby authorized and directed to make inspections to determine the condition of dwellings, dwelling units, rooming houses, rooming units and premises located within the City in order that they may perform their duty of safeguarding the health and safety of the occupants of dwellings and of the general public. For the purpose of making such inspections and upon showing appropriate identification, the above designated official or his agent is hereby authorized to enter, examine and survey, at any reasonable hour, all dwellings, dwelling units, rooming houses, rooming units and premises. The owner or occupant of every dwelling, dwelling unit, rooming house and rooming unit, or the person in charge thereof, shall give them free access to such dwelling, dwelling unit, rooming house or rooming unit and its premises at any reasonable hour for the purpose of
such inspection, examination and survey.
   (b)    An owner of a dwelling, structure or premises or his authorized agent may enter the dwelling at all reasonable times for the purpose of complying with any provision of this Housing Code or with any regulation issued thereunder.
   (c)    Every occupant of a dwelling shall give the owner thereof, or his agent or employee, access to any part of such dwelling or its premises at all reasonable times for the purpose of making such repairs or alterations as are necessary to effect compliance with the provisions of this Housing Code or with any rule or regulation adopted and promulgated or any order issued pursuant to the provisions of this Housing Code.
   (d)    In the event the owner or occupant of a dwelling, dwelling unit, rooming house or rooming unit, or the person in charge thereof, fails to give free access to such place and its premises at any reasonable hour for the purpose of inspection, examination or survey, the City shall be authorized to apply to a court of competent jurisdiction and obtain a court order permitting such inspection, examination and survey without the necessity of notice to the adverse party.
