(a) No building permits required under Chapter 1337 for the erection, construction, remodeling or alteration of, addition to, or moving of any building shall be issued unless a lot grading plan which has been certified by a licensed professional engineer or surveyor has first been submitted by the applicant and approved by the City Engineer or Building Inspector.
(b) If the City Engineer has determined that the lot is subject to retention of stormwater, the lot grading plan shall include the retention design and design calculations shall also be submitted. The design calculations for retention design shall be approved by the City Engineer.
(c) The lot grading plan shall be drawn at a scale no less than one inch equals fifty feet, and shall contain, at a minimum, the following information:
(1) Show complete title, location, address, engineer or surveyor certification, list of symbols and abbreviations, and date;
(2) Show lot area in square feet;
(3) Show complete dimensions of new building or addition, sidewalks, drives, means of ingress and egress, and curbs;
(4) Provide north arrow and scale;
(5) Show zoning setbacks, easements and restriction lines;
(6) Show adjacent streets to the centerline of the right-of-way and adjoining properties and building with names and addresses of owners;
(7) Show location and elevation of benchmark used;
(8) Show location, size and elevation data relating to existing storm sewers, catch basins, manholes and ditches;
(9) Show existing elevations of curbs, gutters, ground on lot, ground grade at foundation of adjacent buildings and centerline of pavement; and
(10) Show proposed elevations of basement, first floor, ground grade at foundation, ground on lot, parking lots and drives, sidewalks, catch basins, yard drains and inlets and indicate slopes with drainage arrows where applicable.
(d) The lot grading plan shall be designed using the following criteria:
(1) All standing water shall drain off within twenty-four hours after the end of a storm within a ten-year frequency;
(2) The minimum slope away from the building foundation shall be one-fourth inch per foot on all sides for a minimum of eight feet;
(3) Building foundations shall extend a minimum of eight inches above the ground;
(4) Swales shall be constructed along the side lot lines so that water ponding on the site shall not flood the building on the site or adjacent buildings. Swales along the side lot lines shall be designed for the use of adjacent property owners.
(e) After the lot grading plan has been approved, the building permit has been issued, and construction has begun, but prior to proceeding with construction above the foundation, the lot shall be rough graded and a letter from a licensed professional engineer or surveyor shall be presented to the Building Inspector stating that the building is at or above the proposed plan grade and that the lot as graded shall not cause flooding of adjacent buildings.
(f) Prior to occupancy, the lot shall be fine graded and a letter shall be presented to the Building Inspector from a licensed professional engineer or surveyor that he has checked the grades and that the lot is in compliance with the approved grading plan. If the grading is not completed at the time of occupancy, the owner shall establish an escrow with the City, which the City may use or return at any time after sixty days, to cover the cost of bringing the grading into compliance with the lot grading plan. The Building Inspector shall determine the amount of the escrow.

(g) A plan review fee in accordance with the schedule of fees approved by Council shall be submitted to the Building Inspector with the site grading plan.

(h) In any case wherein an application is made for a building permit to remodel, make an addition to or alter an existing building which was built in conformity with the grade established by the proper municipal authority, the Building Inspector is hereby authorized to waive the foregoing requirements of the preparation of a lot grading plan if he shall determine that the remodeling, alteration or addition shall be constructed in conformity with the grade theretofore established.
(i) Anyone wishing to change or alter an established grade which was constructed and approved by the proper municipal authority shall present a lot grading plan conforming to the requirements stated herein. After the changes or alterations have been made, a letter shall be presented to the Building Inspector from a licensed professional engineer or surveyor that he has checked the grades and that the lot is in conformance with the approved lot grading plan.
