§ 153.04 APPROVAL PROCEDURES.
   (A)   (1)   Plans shall be filed at the village city hall at least 30 days prior to the meeting of the Planning Commission. The Planning Commission or its duly authorized representative shall review these plans as submitted. The Planning Commission or its duly authorized representative shall take the necessary steps to ensure compliance by the applicant with these plans as finally approved.
      (2)   A copy of preliminary plans or extension of previously approved plans requiring complex soil erosion and sediment control measures may be referred to the Hamilton County Soil and Water Conservation District for review and recommendation as to adequate soil erosion and sediment control measures to prevent damage to other properties.
   (B)   (1)   In order to ensure that emergency measures could be taken by the village if the soil erosion and sediment control measures were not implemented according to the agreed upon plan and schedule, a performance bond in the amount of the cost of the soil erosion and sediment control measures shall be required.
      (2)   In this regard, the plan shall be accompanied by written instructions to the escrow holder which shall authorize the escrow holder to convey to the village the cash guarantee upon recommendation of the Planning Commission that emergency action by the village is required to complete the provisions of the plan, or convey to the applicant upon approval, by recommendation of the Planning Commission the satisfactory completion of the plan.
   (C)   The Planning Commission or its duly authorized representative shall make a continuing review and evaluation of the methods used and overall effectiveness of the soil erosion and sediment control program.
