For purposes of this chapter, and the interpretation and enforcement thereof, the following words and phrases shall have the following meanings:
APPLICANT. Any person who seeks to obtain a construction permit.
CONSTRUCTION PERMIT. Any authorization for use of the public rights-of-way granted in accordance with the terms of this chapter, and the laws and policies of the village.
EXCAVATE. To dig into or in any way remove or physically disturb or penetrate any part of the right-of-way.
FACILITY or FACILITIES. The plant, equipment and/or property, including but not limited to, cables, fibers, wires, pipes, conduits, ducts, pedestals, antennae, electronics, poles, mains, plants and other appurtenances located under, on or above the surface of the ground within the rights-of-way of the village.
PERMIT HOLDER. The holder of a valid Construction Permit issued pursuant to this chapter.
PERSON. Individuals, corporations, companies, associations, joint stock companies or associations, firms, partnerships, limited liability companies, trusts, and includes their successors, trustees, receivers and assigns, and any other legal entity.
PUBLIC STREET. means any highway, street, alley or other public roadway for motor vehicle travel under the jurisdiction and control of the village, which has been acquired by, established by, or dedicated to the village.
PUBLIC WAY. Right-of-way and includes all public streets and utility easements as those terms are herein defined herein, now or hereafter owned by the village.
RIGHT-OF-WAY. The surface of and the space above and below any public highway, street, way, place, alley, sidewalk, and easement dedicated to public use, including but not limited to, sidewalks, roadways, shoulders and berms, ditches and slopes extending to the right-of-way limits dedicated to public use.
UTILITY EASEMENT. Any easement owned by the village and acquired, established, and dedicated for public utility purposes.
VILLAGE. The municipality of Amberley Village, Ohio.
VILLAGE ENGINEER. The individual or company under contract to provide professional engineering services to the village.
VILLAGE MANAGER. The administrative head of the municipal government known as Amberley Village, Ohio.
WORK or WORK ACTIVITY. Any labor or other action performed within a right-of-way; or any use or storage of equipment or materials within a right-of-way, including but not limited to, construction of streets and all related appurtenances, fixtures, improvements, sidewalks, driveway openings, street lights, and traffic signal devices within a right-of-way. Work or work activity also includes excavation, construction, maintenance or repair of all underground structures such as pipes, conduit, tunnels, manholes, vaults, buried cable, wire, or any other structure located below surface, and installation of overhead poles or facilities attached to any above ground structure used for any purpose within a right-of-way.
