§ 36.08 RETIRING POLICE OFFICERS ABLE TO PURCHASE SIDEARM; RECEIVE BADGE AS GIFT.
   (A)   Effective as of April 1, 1992, a police officer who is retiring from service with the village under honorable conditions, who has completed at least 25 years of service as a police officer, of which at least 13 years of service has been continuous with the village, shall be entitled to retain as a gift his or her Police Department badge and shall be permitted to purchase his or her Police Department sidearm for a fee not to exceed $1; the sale of the sidearm being conditioned upon the agreement of the police officer that he or she will neither sell nor make a gift of the firearm during his or her lifetime.
   (B)   A retiring police officer wishing to purchase his or her sidearm shall first present the sidearm to the Police Chief who will check the firearm for correct serial number which shall be recorded in a permanent record of the Police Department.
   (C)   Upon termination of active duty with the Police Department, before receiving his or her firearm, the police officer shall sign a receipt for such firearm to be prepared by the Police Chief, such receipt to include the serial number of the firearm and a statement by the retiring officer that he or she will neither sell nor make a gift of the firearm during his or her lifetime.
