ORDINANCE NO. 309
AN ORDINANCE GRANTING TO W ESTERN RESOURCES, INC., (dba KPL), A KANSAS CORPORATION, ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO CONSTRUCT, OPERATE, AND MAINTAIN ELECTRIC LINES OVER THE STREETS, AVENUES, AND ALLEYS OF THE CITY OF ALMA, KANSAS.
Section 1. That in consideration of the benefits that may be derived by the city of Alma, Kansas, and its inhabitants, there is hereby granted to Western Resources, Inc., a Kansas corporation, its successors and assigns, hereunder sometimes designated company, the right, privilege and authority for a period of 35 years from the 1st day of August, 1992, to occupy and use the several streets, avenues, alleys, bridges, parks, parkings, or public places of the city that may be necessary for the construction, operation and maintenance of electric lines as such electric lines now exist or as they may be changed from time to time along such existing route or new routes as the company and city may mutually agree to in writing.
Nothing contained in this ordinance shall be construed to give company the right to sell electric energy at retail to any other inhabitants of the City of Alma, Kansas.
Section 2. That company, in the construction, operation and maintenance of its electric facilities, in and through the city, shall use all reasonable and proper precaution to avoid damage or injury to persons or property, and shall hold and save harmless the city from any and all damage, injury and expense caused by the sole negligence of company or its agents or servants.
Section 3. That during the term of this grant, the poles, wires and other electrical equipment of company shall not be subject to any city occupation or license taxes. This franchise is granted pursuant to the provisions of K.S.A.
