If an increase in the amount of wastewater discharged by any sewer service customer (“Increased Discharge”) will require the city to improve or expand its wastewater treatment facilities, such customer shall pay the city for all capital costs, interest, costs of service (including operation and maintenance), treatment repairs and rehabilitation attributable to such Increased Discharge and expansions of treatment facilities. The terms and conditions pursuant to which such amounts will be paid shall be set forth in a formal, written agreement between the city and such customer.
