15-440.   SEWER SERVICE CHARGE.
The monthly charge for sewer service shall be as follows:
   (a)   Class 1: Light Residential and Light Commercial Users Residential and commercial users which use less than 1,500 gallons of water per month - $29.
   (b)   Class 2: Residential Users: Single family residential users who use more than 1,500 gallons of water per month - $32.50 per month.
   (c)   Class 3: Small Commercial Users: Non-residential users who use more than 1,500 gallons and less than 12,000 gallons of water per month. - $36.50.
   (d)   Class 4: Light Commercial Users: Non-residential users which use more than 12,000 gallons and less than 25,000 gallons of water per month. - $180.00.
   (e)   Class 5: Medium Commercial Users: Non-residential users which use more than 25,000 gallons and less than 75,000 gallons of water per month. - $250.00
   (f)   Class 6: Heavy Commercial Users: Non-residential users which use more than 75,000 gallons and less than 125,000 gallons of water per month. - $400.00.
   (g)   Class 7: Industrial Users: Non-residential users which use more than 125,000 gallons of water per month. - $850.00.
   (h)   Class 8: Out-of-Town Residential Users: Single family residential users who are outside the limits of the city - $36.50.
   (i)   Class 9: Special Rates: Such rates shall apply to non-residential users when the city determines, based on applicable standards, that special conditions surround the use of city sewer services to the extent that the application of the charges set forth above for Classes 1 through 8 would be inequitable or unfair to either the city or sewer service customer. Such rates may be applied in instances including, but not limited to, the following:
      (1)   Where the nature of the use of water is such that the resulting sewage or industrial waste has characteristics making it more difficult to process than ordinary domestic waste.
      (2)   Where a major proportion of the water is not discharged into or does not reach the sanitary sewer.
      (3)   Where water service is not supplied by the city.
   When the city determines that Special Rates shall apply, it shall pass a Resolution stating that fact. In that event, the sewer service customer and the city shall enter into a written agreement which shall establish appropriate rates for such customers, based on the city’s determination of the need for Special Rates, and such customers shall pay the rates set forth in such written agreement.
