It shall be unlawful for any person or persons to dig a grave or bury a body (including cremation ashes in an urn) within the cemetery grounds without first having obtained permission from the superintendent and giving him or her a report of the deceased. (Ord. 294, Sec. 6)
All monuments shall not exceed 18 inches in height, 24 inches in length and 12 inches in width for each grave site, except when one monument will be used for two grave sites, then the length cannot be over 32 inches in length. All monuments must be set on a concrete base which is four inches wider and four inches longer than the monument, and four inches thick. The concrete base must be level with the ground. Anyone erecting or setting a monument or stone in the city cemetery must confer with the cemetery superintendent prior to beginning any work thereon, and shall locate such monument or stone precisely in the location designated by the cemetery superintendent and according to the specifications above set forth. Any person or persons who shall willfully destroy, mutilate, injure or remove any tomb, monument, grave stone, grave marker, or other structure placed in the cemetery grounds, or any part thereof, shall be deemed guilty of a misdemeanor, and upon conviction, shall be fined in any sum not exceeding $500, or confined in the jail of Wabaunsee County, Kansas, for a term of not exceeding 90 days, or both such fine and imprisonment. It shall be unlawful for any person or persons to ride or drive any type of vehicle, animal or other type conveyance upon or across any lots in the cemetery, except as part of the maintenance of the cemetery, opening or closing a grave, a burial or setting of a grave marker, or to mar, injure or destroy any trees, grass, shrubbery, drives, or other property in or about the cemetery grounds, or break open any gates or fences around or in the cemetery.
