(a) No person, being the owner, operator, lessee, manager, employee or other agent of any restaurant, shall sell or offer for sale any of its products through a drive-thru facility between the hours of 1:00 a.m. and 6:00 a.m., if the restaurant is located within 250 linear feet of any residential structure.
(b) Whoever violates this section is guilty of a minor misdemeanor on a first offense; a misdemeanor of the fourth degree on a second offense and a misdemeanor of the third degree on each subsequent offense. (Ord. 88-86. Passed 8-3-87.)
