505.11 KEEPING FARM ANIMALS RESTRICTED.
   (a)   Definitions.
      (1)   “Person” includes a natural person, association, partnership, organization or corporation.
      (2)   “Own, keep, harbor or permit” includes having legal title, custody or control over a farm animal.
      (3)   "Wild animal" means any living wild or potentially dangerous mammal, reptile, fowl or other vertebrate species which is not naturally tame or gentle, but is of a wild nature or disposition and not customarily domesticated, and which because of its characteristics may constitute a danger to people or property if it escaped from secure quarters.
   (b)   No person shall own, keep, harbor or permit any of the following farm animals.
      (1)   Cows
      (2)   Chickens
      (3)   Sheep
      (4)   Goats
      (5)   Ducks
      (6)   Geese
      (7)   Llamas
      (8)   Donkeys
      (9)   Horses
      (10)   Hogs and swine
      (11)   Buffaloes.
   (c)   Rabbits are permitted, but must be confined to pens if located outside. Five or more adult rabbits owned, kept or harbored, must be confined to pens located no less than fifty feet from any building used as a residence.
   (d)   Baby poultry including chicks and ducklings are exempt as provided in Section 505.12(a).
   (e)   Any animal not prohibited if located outside must be confined to pens not less than 100 feet from any building used as a residence.
   (f)   The Director of Public Safety and Service shall promulgate regulations to exempt farm animals as are listed in this section from its provisions as to any circus, carnival, zoo or other event for entertainment or education as defined therein so as to protect life, property and public safety.
      (1)   Any person seeking an exemption for any farm animal or animals shall be required to file an application with the Director of Public Safety and Service.
      (2)   No such exemption shall be granted unless all the regulations established by the Director of Public Safety and Service are complied with and a bond or liability insurance are provided.
      (3)   The regulations and amendments thereto established under this section shall be reduced to writing, filed with the Clerk of Council and maintained in the office of the Mayor and the Health Department.
      (4)   An application for an exemption from this section shall be accompanied by the payment of a fee of $25.00.
   (g)   Whoever violates this section is guilty of a minor misdemeanor.
