(a) Composition. The Enterprise Zone Tax Incentive Negotiating Board shall be composed of the three members of the Alliance Community Development Committee of Council.
(b) Duties. It shall be the responsibility of the Negotiating Board to provide, to accept, to review and to duly process applications for tax incentives relating to the bona fide projects within the City's Enterprise Zone generally consistent with the guidelines established herein and approved by the City from time to time. The Negotiating Board shall submit its recommendations concerning the granting of tax incentives to Council and to the Board of Education for each bona fide application it receives as promptly as possible. These recommendations shall be in a form sufficient to be translated into an appropriate tax incentive agreement to be prepared by the City and submitted to Council for its approval, and the County for its approval; any deviations from these guidelines shall be accompanied by explanations from the Negotiating Board.
The Board of Education shall offer a formal advisory opinion concerning the recommendation of the Negotiating Board for the consideration of the City. Such action by the Board of Education would occur at a date no later than that of the Board of Education's next regularly scheduled meeting following a recommendation of the Negotiating Board.
The chairman shall call meetings of the Board whenever necessary, giving at least twenty-four hours notice of each meeting. A quorum shall be constituted by a minimum of two members of the Board, and any recommendation concerning tax incentive to Council shall require the affirmative vote of two members of the Board. In all other matters respecting parliamentary procedure, Roberts’ Rules of Order shall govern. The Board is deemed to be a public body and is subject to Ohio R.C. Section 121.22 (the "Sunshine" Law).
