781.10 CONDITIONS AND REGULATIONS.
   n addition to any other condition or regulation contained in this chapter, other provisions of the Codified Ordinances of the City of Alliance, or in Ohio Revised Code or Ohio Administrative Code, the following conditions and regulations shall be applicable to and shall govern and control the license of a sweepstakes terminal café: (Ord. 32-12.    (a)    Each licensee shall at all times open each and every public or semi-public portion of the premises for inspection by the Police Department and other City Departments for the purpose of enforcing any provisions of this Chapter. The interior of the main premises must be easily and readily viewable from the exterior through at least one main window without obstruction, blackout or other shading.

   (b)    Each licensee shall have present on the premises at all times when the premises are open to the public at least one adult operator who has not been convicted of any crime referenced in Section 781.09(a). (Ord. 32-12. Passed 4-2-12.)
   (c)    No such licensee shall open the premises for business except between the following hours (local time) on the following days:
      (1)   9:00 a.m. to 2:00 a.m. during all days.

   (d)   No licensee shall allow living quarters to exist with direct entry to the premises.
   (e)   No such licensee shall allow any person, other than an owner or operator over the age of eighteen (18) years, who shall be readily identifiable, to be in control of premises.
   (f)   The licensee shall ensure that the operator is regularly situated in a place upon the premises from which he or she has an unobstructed view of the entire portion of the premises devoted to the operation of computerized sweepstakes device.
   (g)    No person under the age of eighteen (18) years shall be permitted in a sweepstakes terminal café.
   (h)    All sweepstakes rules and odds of winning shall be posted in a conspicuous place at the premises and displayed on the computerized sweepstakes device at the start of each game and/or activity.
   (i)    Each licensee shall operate the sweepstakes terminal café business in compliance with all pertinent Federal Trade Commission rules and regulations.
   (j)    Every premises or a sweepstakes terminal café shall provide notice on the main entry door, at the cash register, and at each computerized sweepstakes device terminal, which shall appear clearly and conspicuously in bold-face type of the minimum size of 14 point fount at the register and device terminal and 72 point fount at the main entry door in substantially the following form:
      (1)    No alcohol, beer or intoxicating liquor permitted.
      (2)    No purchase necessary to participate in this Sweepstakes Café.
   (k)   All Computerized sweepstakes devices upon the premises of a sweepstakes terminal café shall be located thereon in conformity with the floor plan filed with the application for the license. The floor plan shall ensure the following:
      (1)    Non-impairment of ingress or egress to the premises;
      (2)    Non-interference with free and unfettered passage through the premises;
      (3)    Allowance of a minimum of thirty (30) square feet of floor area for each amusement device excluding areas used for other principal uses;
      (4)    Allowance of a minimum unobstructed area of three (3) feet on either side of each amusement device where persons may use, watch or wait to use such amusement device;
      (5)    A clear and complete view of the interior of the premises immediately upon entry.
   (l)    Delineated areas for said café shall be clearly marked.
   (m)    The Licensee shall be responsible for submitting a documented statement containing any and all winnings from each computerized sweepstake device. Said statement shall be provided to the Tax Department on or before the fifteenth of the following month. (Ord. 32-12. Passed 4-2-12.)
