No sweepstakes terminal café license shall be issued or renewed for any business or premises where any of the following facts or circumstances exist:
(a) Any of the owners or operators have been convicted within the last five (5) years of any felony.
(b) Any of the owners or operators have been convicted within the past five (5) years of any misdemeanor involving the operation of a sweepstakes terminal café business, or involving physical violence, gambling activities, controlled substances, alcoholic beverages, or crimes involving minors.
(c) The premises does not specifically designate at least thirty (30) gross square feet of floor area for each amusement device to be located upon the premises, excluding areas used for other principal uses.
(d) The premises does not provide a minimum of one (1) parking space for every ONE (1) computerized sweepstake devices.
(e) The premises is located within one Thousand (1,000) feet of any school, playground, public park, liquor establisment, cash loan business, or another sweepstakes café, or within five hundred (500) feet of any church.
(f) The premises or operation thereof would be in violation of any provision of the Building Code, Zoning Code, Fire Code of the City or any other pertinent provisions of local, state or federal law.
(g) The applicant made a false statement as to a material matter upon the application or in a hearing concerning the license.
(h) The application failed to provide all of the required information.
(i) The premises are prohibited from having interior access to a liquor establishment.
(j) The terms and conditions under this chapter and all other applicable ordinances and statutes have not been complied with.
