141.04 PRIVATE POLICE; RULES AND REGULATIONS.
   (a)    The Director of Public Safety and Service is hereby authorized to commission private policemen within the City pursuant to Ohio R.C. 737.05.
   (b)    The following rules and regulations shall apply to private policemen and their commissioning:
      (1)   A private policeman shall receive no compensation from the City for his duties as such, unless the private policeman is employed directly by the Police Department;
      (2)    A private policeman shall not be on the classified list of the Police Department nor eligible for participation in the Police and Firemen's Disability and Pension Fund;
      (3)    A private policeman shall have all the powers and exercise all duties provided by law for police officers in preserving the peace, protecting persons and property and obeying and enforcing all ordinances of Council and all criminal laws of the State and shall exercise such powers with reference to the private sector of the community;
      (4)    A private policeman shall fulfill the requirements of Ohio R.C. 109.71 through 109.77;
      (5)   A private policeman shall annually file an application for commission with the Director of Public Safety and Service along with an annual fee of twenty-five dollars ($25.00) payable to the City; unless such private policeman is in the employ of the Police Department. Such fee may then be waived by the Director of Public Safety and Service;
      (6)   A private policeman shall be of good moral character;
      (7)    The commission of a private policeman shall be subject to revocation by the Director of Public Safety and Service;
      (8)    A private policeman shall execute and file with the Director of Public Safety and Service a bond in the amount of one thousand dollars ($1,000), with surety thereon authorized to do business in the State, which bond shall be subject to approval by the Law Director. Such bond shall be conditioned upon the faithful observance of the law and shall be for the purposes of indemnifying any person who suffers loss as a result of the act or the failure to act of the person holding such commission;
      (9)    No person who has been dismissed from the regular police force shall be commissioned as a private policeman within a period of three years after such dismissal.
   (c)    The Director of Public Safety and Service is hereby authorized to promulgate further rules and regulations consistent with the rules and regulations set forth in subsection (b) hereof.
