Existing retail fuel outlets which are either in existence or under construction as of the date of adoption of this chapter shall not be required to build or construct new or additional restroom facilities to conform to this chapter, but shall be required to make existing restroom facilities available for use by the public. In the event any existing retail fuel outlet shall be modified, or remodeled to such an extent that a building permit is required to be issued, then such retail fuel outlet shall thereafter conform to the provisions of this chapter.
