Driveway approaches or inclines leading into a street which are not being used as a driveway approach or incline, either through change of circumstances, relocation of buildings or for any other reason, are hereby declared to be a nuisance and shall be removed. A sidewalk and curb shall be constructed thereat by the owner of the property abutting such sidewalk within thirty days of receipt of notice from the City Engineer that such nuisance exists. Failure to comply with such notice shall be unlawful and a misdemeanor, and failure to comply in each five-day period thereafter shall be considered a separate offense.
