No permit shall be issued to drill a well for the production of oil or gas unless the proposed well, sludge pit, and storage tank batteries are located:
(a) In an Industrial Zone designated by I-l or I-2 under the Zoning Ordinance presently in force or as hereafter amended.
(b) Upon a tract or drilling unit containing not less than forty acres which forty acre tract may include acreage located in districts zoned for industrial, commercial, residential, and/or college land uses;
(c) Not less than 230 feet from a boundary line of the subject tract or drilling unit;
(d) Not less than 250 feet from any building designed for human occupancy or building where the public assembles or congregates;
(e) Not less than 150 feet from any road, highway, street or alley;
The distance requirements in items c, d, and e may be reduced for gas and oil wells located in Industrial Zones if, in the opinion of Council, the distance requirements present an undue hardship to the applicant and the reduced distances do not present an undue threat to the public health, safety and welfare. Council shall be the sole authority permitted to grant said exceptions.
Proposed sites will be considered from the perspective of both existing and future development and should not be located so as to be potentially detrimental to the future use and development of the parcel(s) upon which the well is to be located or any of the adjoining parcels.
All future buildings to be constructed that are designed for human occupancy or buildings where the public assembles or congregates shall be located at least 250 feet from any existing well or storage tank batteries. This distance may be reduced if, in the opinion of Council, the distance requirement presents an undue hardship to the owner and the reduced distance does not present an undue threat to the public health, safety and welfare.
