742.01 LOCAL PREFERENCE.   
   (a)   The Board of Control in its sole discretion in determining the lowest and best bidder, is authorized to award locally funded contracts to local bidders whose bid is not more than five percent (5%) higher than the low dollar bid submitted by a non-local bidder, for the first $100,000 of any counter bid plus three percent (3%) for any amount over $100,000 of any contract bid.
   (b)   Local bidder shall be defined as an individual or business entity who:
      (1)   Has a principal place of business located within the corporate limits of the City of Alliance as registered in official documents filed with the Secretary of State’s Office, State of Ohio; or   
      (2)   Holds a valid vendor’s license which indicates that its place of business is located within the corporate limits of the City of Alliance; or
      (3)   Utilizes vendors, suppliers or subcontractors which have as their principal place of business a location within the corporate limits of the City of Alliance; but only to the extent of the value of the contract bid that is directly attributed to the local vendors, suppliers or subcontractors.
   (c)   All future contract specifications and/or bid documents that are distributed by the City of Alliance for the purposes of soliciting bids for goods and/or services shall prominently display the following notice:
NOTICE
   Prospective bidders will take note that the City of Alliance shall have discretion through its Board of Control, to determine that any bid submitted by a local bidder or a portion of that bid which is directly attributed to local vendors, suppliers or subcontractors which is not more than five percent (5%) higher than the low dollar bid is, in fact, the lowest and best bid for purposes of awarding this contract for the first $100,000 of any contract bid plus three percent (3%) for any amount over $100,000. Local bidder shall be defined as an individual’s business entity who:
   (a)   Has a principal place of business located within the corporate limits of the City of Alliance as registered in the official documents filed with the Secretary of State, State of Ohio; or
   (b)   Holds a valid vendor’s license which indicates that its place of business is located within the corporate limits of the City of Alliance; or
      (c)   Utilizes vendors, suppliers or subcontractors which have as their principal place of business a location within the corporate limits of the City of Alliance; but only to the extent of the value of the contract bid that is directly attributed to the local vendors, suppliers or subcontractors.
   (d)   Notwithstanding anything herein to the contrary, this section shall be applicable to all contracts for the purchase of materials, equipment, supplies or services which are purchased, leased or constructed at a cost in excess of $5,000 and which require bidding pursuant to Ohio Revised Code Section 735.05 through 735.09 and Ohio Revised Code 737.03.
