If damage results to the subject sidewalk or curb, permittee may elect to repair same in accordance with the specifications imposed by the Director of Public Works and subject to his approval. In the event that the permittee shall not so elect, the Director of Public Works shall make the necessary repairs and deduct the cost of same from the deposit on file. If there shall be a balance remaining on deposit after deducting such cost, it shall be returned to the permittee. If the cost of such repairs shall exceed the amount of the deposit, the permittee shall pay to the city the cost in excess of the deposit.
