§ 23.20.080 FLEXIBLE DEVELOPMENT STANDARDS.
   (A)   The special objectives of the flexible development standards in the R-3 zone are to:
      (1)   Promote higher quality multiple-family residential development by providing a more flexible approach to development standards;
      (2)   Encourage innovative design and efficient use of land which might otherwise be stifled by standard, rigid development standards;
      (3)   Encourage the consolidation of parcels;
      (4)   Permit developments to be judged on individual merits and overall impacts on the site and the neighborhood.
   (B)   In order to encourage the development of higher quality multiple-family residential projects in accordance with the above objectives, an applicant for a residential planned development may request, and the Planning Commission may grant, subject to the findings in division (C) below, three variations to the provisions contained in Chapter 23.20, three variations to the provisions contained in Chapter 23.42 and three variations to the provisions contained in Chapter 23.44 of this title. In addition to the variations listed above, flexible parking standards may also be requested per § 23.52.060 of this code.
   (C)   In order for a variation to be granted, the following findings must be made in a positive manner:
      (1)   That the variation is necessary to achieve a better design than that which would result from application of the existing regulations;
      (2)   That the variation will materially affect adjoining properties and will contribute to a better overall development than would be possible under the existing regulations.
   (D)   All developments utilizing the flexible development standards shall have a minimum net parcel area of 40,000 square feet.
