§ 91.99 PENALTY.
   (A)   If any person, firm, or corporation shall violate any of the provisions of this chapter or shall fail to perform any duty lawfully enjoined within time prescribed by the Fire Chief or shall fail, neglect, or refuse to obey any lawful order given by the Fire Chief in connection with the provisions of this chapter, such person, firm, or corporation shall be fined for each such violation, failure, or refusal based on current state-approved amounts and/or as set by City Council from time to time. Each day of such unlawful activity shall constitute a separate offense.
   (B)   (1)   Any person found to be in violation of § 91.37 shall be subject to a minimum fine for each violation cited based on current state-approved amounts and/or as set by City Council from time to time.
      (2)   The City Court shall be the court of jurisdiction for determining all violations cited pursuant to § 91.37.
   (C)   Any person committing a second violation of § 91.38 within 12 months of the first violation of this section may be fined based on current state-approved amounts and/or as set by City Council from time to time. Any person committing a third or subsequent violation within 12 months of the second violation of this section may receive a fine based on current state-approved amounts and/or as set by City Council from time to time.
