§ 90.087 CONFISCATION AND EUTHANIZATION.
   (A)   Upon a finding by a court of competent jurisdiction that an animal is a vicious animal, as defined herein, and the suspicious animal does not have a valid permit in accordance with the provisions of this or any other state or local ordinance, has an owner who has not secured or maintained liability insurance in accordance with the provisions of this chapter, or is outside of its dwelling or outside of its enclosure in violation of the provisions of this chapter, such vicious animal shall be confiscated by the ACO, upon court order, and be destroyed in an expedited and humane manner.
   (B)   If, when unprovoked, a vicious animal kills, wounds, or assists in killing a domesticated animal, the animal shall be confiscated by the ACO and destroyed in an expedited and humane manner.
   (C)   If, when unprovoked, a vicious animal attacks, assaults, wounds, bites, or otherwise injures or kills a human being, the vicious animal shall be confiscated by the ACO, upon order of a court of competent jurisdiction, and destroyed in an expedited and humane manner.
