3-2-9: HOURS OF OPERATION:
   (A)   Hours: No alcoholic liquor shall be sold at retail or consumed on any licensed premises between the hours of twelve o'clock (12:00) midnight and seven o'clock (7:00) A.M. on any Monday through Friday; no alcoholic liquor shall be sold at retail or consumed on any licensed premises between the hours of one o'clock (1:00) A.M. and seven o'clock (7:00) A.M. on any Saturday; and no alcoholic liquor shall be sold at retail or consumed on any licensed premises between the hours of one o'clock (1:00) A.M. and twelve o'clock (12:00) noon on any Sunday. Any licensee shall have the right to open its licensed premises for Sunday sales at retail or consumption of alcoholic liquor on the premises if permitted by the license classification for such licensee from twelve o'clock (12:00) noon to twelve o'clock (12:00) midnight on each Sunday, provided that any such licensee has first filed with the City's Chief of Police a written statement as to the hours that such licensee will be open for Sunday liquor sales, or in the case of special events or entertainment, a written statement as to the hours that such licensee will be open for Sunday liquor sales during any special events or entertainment. Failure to file a written statement with the Chief of Police as required herein shall prohibit any licensee from opening its premises for Sunday liquor sales and such failure to file shall be deemed a violation of this section if the licensee opens its licensed premises for Sunday liquor sales without first having filed the requisite written statement with the City's Chief of Police.    (B)   Closing Hours: The above hours shall also be deemed closing hours for each licensee. Patrons shall not be allowed to loiter, or remain, for more than fifteen (15) minutes after closing hours. All licensed premises shall remain closed until authorized to open up except for Class A, B, and D holders who may reopen their licensed premises for other authorized business activities only at five o'clock (5:00) A.M. on Monday through Sunday, the prohibition against the sale or consumption of alcoholic liquors on any licensed premises during closing hours as defined above extending to all licensees.    (C)   New Year's Eve: Notwithstanding the above closing hours for the sale or consumption of alcoholic liquor on licensed premises, in the case of New Year's Eve, all licensees shall have the right to remain open that evening and sell alcoholic liquor until two o'clock (2:00) A.M. on New Year's Day. If New Year's Eve (December 31) falls on a Sunday, those licensees who do not have a license to operate on Sundays shall nevertheless have the right to open for business at four o'clock (4:00) P.M. on New Year's Eve with all other licensees having a license to operate on Sundays at such time to open on that day at the time as authorized under the respective type of liquor license issued to such licensees.
