3-2-1: DEFINITIONS:
Whenever the following terms are used in this chapter, they shall have the definitions as set forth below unless the context clearly states otherwise:
   ALCOHOL: The product of distillation of any fermented liquid, whether rectified or diluted, whatever may be the origin thereof, and includes synthetic ethyl alcohol. It does not include alcohol or wood alcohol.
   ALCOHOLIC LIQUOR: Any alcohol, spirits, wine, beer, ale or other liquid containing more than one-half of one percent (0.5%) alcohol by volume, which is fit for consumption as a beverage by a human being.
   BAR: A counter at which alcoholic liquor is served.
   BOWLING ALLEY: Every establishment or building, or part of an establishment or building, as the case may be, wherein the game of bowling is played with composition balls and ten (10) wooden pins.
   CLUB: A corporation organized under the laws of the State of Illinois, not for pecuniary profit, solely for the promotion of some common object other than the sale or consumption of alcoholic liquors as defined by 235 Illinois Compiled Statutes 5/1-3.24. Moreover, a club shall file a copy of its charter with the City Clerk.
   DELIVER OR DELIVERY: The actual, constructive, or attempted transfer of possession of alcoholic liquor.
   HOMEBREW: Beer or any other beverage obtained by the process of alcoholic fermentation of an infusion or concoction of grains, sugars, or both in water and includes, but is not limited to, beer, mead, and cider made by a person twenty one (21) years of age or older through their own efforts, fermented at their place of residence, at another place of residence of a homemade brewed beverage brewer, or at a premises of a commercial enterprise engaged primarily in selling supplies and equipment for use by homebrewers and not for a commercial purpose but for consumption by that person, their family, neighbors, guests, and friends or for use at an exhibition, demonstration, judging, tasting, or sampling with sampling sizes as authorized by section 6-31 of the Illinois Liquor Control Act or as part of a contest or competition authorized by section 6-36.
   HOMEBREWER: Any person twenty one (21) years of age or older: a) who makes homebrew where the total quantity of homebrew made, in a calendar year, by the person does not exceed one hundred (100) gallons if the household has only one person twenty one (21) years of age or older or two hundred (200) gallons if the household has two (2) or more persons twenty one (21) years of age or older; b) who receives no compensation; and c) whose homebrew is not sold or offered for sale.
   HOTEL: Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where food is actually served and consumed and sleeping accommodations are offered for adequate pay to travelers and guests, whether transient, permanent or residential, in which twenty five (25) or more rooms are used for the sleeping accommodations of such guests and having one or more public dining rooms where meals are served to such guests, such sleeping accommodations and dining rooms being conducted in the same building or buildings in connection therewith and such building or buildings, structure or structures being provided with adequate and sanitary kitchen and dining room equipment and capacity.
   LICENSED PREMISES: The entire building or structure which contains any bar or bars.
   LICENSEE: Any person or persons, partnership, firm, or corporation named on the liquor license as issued by the City of Aledo.
   MINOR: A person who has not attained his or her twenty first birthday.
   NOT FOR PROFIT CORPORATION: A corporation, organized under the laws of the State of Illinois, no part of the income of which is distributable to its members, directors, or officers; provided, however, that the payment of reasonable compensation for services rendered and the making of distributions upon dissolution or final liquidation shall not be deemed a distribution of income.
   OFFER FOR SALE: To hold out, keep or expose for sale; to possess with intent to sell; to solicit or receive orders for sale.
   ORIGINAL PACKAGE: Any bottle, flask, jug, can, cask, barrel, keg, hogshead, or other receptacle or container used, corked or capped, sealed and labeled by the manufacturer of alcoholic liquor.
   PERSON: Any person, partnership, firm, corporation, club, or any other association of individuals.
   RESTAURANT: Any public place kept, used, maintained, advertised, and held out to the public as a place where meals are served and where meals are actually and regularly served, as the primary monetary function of the business, such place being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable foods for its guests.
   RETAIL SALE: Sale for use or consumption and not for resale in any form.
   RETAILER: A person who sells, or offers for sale, alcoholic liquor for use or consumption and not for resale in any form.
   SALE: Any transfer, exchange or barter in any manner or by any means whatsoever, including the transfer of alcoholic liquors by and through transfer or negotiation of warehouse receipts or certificates, and to include and mean all sales made by any person, whether principal, proprietor, agent, servant or employee.
   SELL AT RETAIL OR SALE AT RETAIL: To effect, make, or contract a sale; to keep or expose for sale; and to keep with intent to sell.
   SPIRITS: Any beverage which contains alcohol obtained by distillation, mixed with water or other substance in solution and includes brandy, rum, whiskey, gin, or other spirituous liquors, and such liquors when rectified, blended or otherwise mixed with alcohol or other substances.
   TO SELL: To solicit or receive an order for, to keep or expose for sale and to keep with intent to sell. (Ord. 9/69, 12-1-1969, eff. 1-1-1970; amd. Ord. 9/85, 10-7-1985; Ord. 07/2017, 4-17-2017)
