8-11-2: MONUMENTS, MARKERS:
It shall be unlawful for any person whatever or whoever, within the corporate limits of the city to move, disturb, remove, deface, molest or destroy any stake, grade, grade stake, monument or marker, set or placed within the city limits for the purpose of establishing either temporarily or permanently any street, sidewalk, or improvement grade or level, or other grade or level in the city, when the same or either of the same may hereafter be placed or designated by or under the authority or direction of the municipal authorities of the city, or where the same or either of the same, may now be legally located or identified or designated by competent legal authority; and it shall further be unlawful for any person in the city to erase or otherwise obliterate or deface any chalk or pencil mark, or other mark made for the purpose of indicating the location of any such grade or level within the city; provided, however that the city engineer or other proper officer acting under the authority or instruction of the municipal authorities shall have the right to move or remove any such monument or marker, providing the same shall be accurately replaced, and its location correctly noted by any such proper person moving or removing any such monument or marker.
