8-10-2: SALE OF CRYPT; FEE:
The Mayor and Clerk shall upon proper application, and the payment of the fee pursuant to title 13, "Schedule Of Fees", of this Code first being made to the Cemetery Committee for each crypt sold, and of which transfer is requested, execute and deliver to the applicant or applicants a certificate of ownership of the number of crypts in said mausoleum which such applicant or applicants show themselves by proper evidence to be entitled, which certificate of ownership shall not be transferable except upon the consent of the said Mayor and Clerk or their successors in office.
The said Cemetery Committee upon receiving the said fee per crypt sold, in the mausoleum, shall as soon as practicable thereafter place the entire amount of said fund at interest, or otherwise safely invest the same, and that the proceeds and income from said fund shall thereafter be used for perpetual maintenance and repair of the mausoleum, the principal of said sum at no time to be used for said purpose except in case of absolute necessity; provided, however, the said Cemetery Committee, nor the City shall in no event be liable for the maintenance and repair of said mausoleum, beyond the amount of the said income from said fund, and the principal of the same.
