8-6-8: WATER AND SEWER RATES 1 :
   (A)   1. Monthly Billings: All water and sewer customers of the City shall be billed on the basis of computations as hereinafter set forth and the minimum monthly consumption for billing purposes shall be one hundred (100) cubic feet per customer per month. (Ord. 16/2017, 6-5-2017)
      2.   Water And Sewer Cost Categories; Restricted Funds And Operation Maintenance And Replacement: Annual costs incurred by the City for water and sewer customers, water source, water treatment, water distribution, sewage collection and sewage treatment shall be classified into two (2) general categories for rate making purposes. The two (2) general categories shall be entitled "restricted funds" and "operation, maintenance and replacement". The anticipated costs for each of these categories shall be annually projected by the City in order to calculate the rates required to recover budget costs for each year. Also, the City shall determine the number of water customers from the preceding fiscal year and the amount of billable flow attributed to all customers in one hundred (100) cubic feet of units averaged over the preceding five (5) fiscal years.
      The number of water customers and the billable flow for all customers shall be obtained from the City Clerk's billing records for the preceding fiscal year.
      The "restricted funds" category referred to herein shall include those costs which are mandated by bond ordinance presently and in the future which must be collected and paid each year that any bond issue or portion thereof remains outstanding. Each outstanding bond issue may have up to five (5) cost components being commonly designated "operation and maintenance account"; "bond and interest account"; "bond and interest reserve account"; "depreciation account"; and "surplus account". The term "restricted funds" shall also include all other forms of indebtedness for the payment of all capital expenditures incurred in connection with the water system.
      Notwithstanding the above definition of "restricted funds", the amount of restricted funds computed under the above definition shall be reduced for the sewer portion thereof as follows for the first two (2) fiscal years:

      The "operation, maintenance and replacement" category referred to herein shall include those costs required to operate, maintain, upgrade and replace equipment used in the waterworks and sewerage system on an annual basis, including pumping, distribution, sewerage collection, capital improvements and administration. In addition, in each of the respective fiscal years designated above, the foregoing category shall also include the lump sum specified above for each such fiscal year in question for the sewer portion thereof.
      3.   Procedure For Computing Monthly Billings: Upon approval of the annual Water and Sewer Fund budget, line item budget entries described therein shall be applied to allocations set forth below:
         (a)   Service Charge: To determine the monthly service charge:
            (1)   Determine the total number of water and sewer customers served on the last day of the preceding fiscal year from reports in the Office of the City Clerk.
            (2)   Divide the total budgeted costs for restricted funds for the coming fiscal year by the total number of water and sewer customers determined under subsection (A)3(a)(1) of this section to compute the annual customer water and sewer service costs.
            (3)   Divide the annual customer service costs by twelve (12) months to determine the monthly customer service charge.
         (b)   Basic User Rate: To determine the basic user rate charge:
            (1)   Determine the average total one hundred (100) cubic feet of units billed over the last preceding five (5) fiscal years.
            (2)   Divide the total budgeted costs for operation, maintenance, and replacement by the total units of one hundred (100) cubic feet of units billed determined under subsection (A)3(b)(1) of this section.
         (c)   Charges To Customers:
            (1)   Minimum Charges: Water and sewer customers consuming one hundred (100) cubic feet of metered water or less per month shall be charged the sum of the service charge plus the product of multiplying the base user rate times the constant unit of one hundred (100) cubic feet of water consumed for such customers.
            (2)   For Customers With Monthly Consumption Above One Hundred Cubic Feet: Water and sewer customers whose monthly water metered consumption is more than one hundred (100) cubic feet shall be charged the sum of the service charge plus the product of multiplying the base user rate times the number of one hundred (100) cubic feet of units consumed.
      4.   Water And Sewer Charge Computation Booklet: There shall be kept on file in the Office of the City Clerk a "Water and Sewer Charge Computation Booklet for the City of Aledo, Illinois", showing the water and sewer charge computations which will be billed to customers as applied through the formula and allocations as herein set forth, and each fiscal year hereafter within thirty (30) days after adoption and approval of the annual Water and Sewer Fund fiscal year budget of the City. The City Clerk shall compile and place on file in his office for public inspection during regular business hours a revised "Water and Sewer Charge Computation Booklet for the City of Aledo, Illinois", showing the updated water and sewer charge computations to be billed to customers based on the then current annual budget figures so adopted and approved and as applied through the formula and allocation herein set forth.
      5.   Measurement Of Flow: The volume of flow used for computing the basic user rate shall be the metered water consumption read to the lowest even increments of cubic feet. (Ord. 14/91, 4-20-1992)
      6.   Nonresident Use: When City water or sewer service is made available to nonresident users, the respective monthly bills therefor shall be determined based upon the calculations set forth in this subsection (A) times two hundred percent (200%) in the case of any nonresident water user and two hundred percent (200%) of the sewerage bill based on the calculation set forth in this subsection (A) except for: a) any not for profit corporation nonresident water user organized for charitable, educational, religious, scientific, research, agricultural, or horticultural purposes, and b) any nonresident user connecting to the City's water transmission line located between the City's west corporate limits and the City treatment plant shall only pay one hundred percent (100%) of the amount calculated to be due for its water usage charge under this subsection (A).       7.   Sewer Service Without Water Service: When a sewer service is allowed without a corresponding water connection, the monthly rate shall be based on an estimated usage determined by the Director of Public Works and Utilities and applied to the current sewer rate structure.       8.   Bulk Sales, Tank: Sale of water in bulk to consumers desiring the same will be made at the water treatment plant through a coin operated meter at the rate pursuant to title 13, "Schedule Of Fees", of this Code. Consumer will furnish necessary containers for such water and any transportation thereof. (Ord. 16/2017, 6-5-2017)
      9.   Miscellaneous Provisions: Notwithstanding the above rates, any park district organized under Illinois law or religious corporation or organization owning or leasing any entire building or structure within the City, which is used solely for nonresidential purposes related to its main function, shall pay the minimum water service charge per quarter for each water connection to any such building or structure and if the latter are also connected to the City's sewer system, shall pay the additional minimum charge per quarter for each sewer connection thereto as a sewer service charge. However, no water and sewer charges shall be imposed on the swimming pool located in the City and owned by the park district due to the terms of a prior existing contract whereby WPA constructed such improvement at no cost to the City in exchange for a covenant by the City to impose no utility charges thereon.
   Upon request by the City, a responsible officer of any religious corporation or organization shall certify in writing as to the religious status of the corporation or organization, depending upon whatever the case may be, and in addition thereto, shall furnish copies of corporate or organization documents or business records establishing the religious purpose thereof.
   (B)   The owner of the premises and the occupant thereof and the user of either water or sewerage service, or both water and sewerage service, shall be jointly and severally liable to pay for the service on said premises, and the service is furnished to the premises by the City only upon the condition that the owner of the premises, occupant and user of the service are jointly and severally liable therefor to the City. Water and sewer bills shall be rendered monthly and shall be payable by the fifth day of the month following its date of rendition. If not paid by that date, the account shall be considered delinquent and a service charge of one and one-half percent (11/2%) for each month or fraction of a month (18 percent annual rate) shall be assessed on the outstanding amount due at the close of the fifth day of the month following the month the statement in question was rendered excluding any service charges previously assessed thereon.    (C)   In the event said rates or charges for water and sewerage service, or either of them, are not paid within thirty (30) days after the rendition of the bill for such service, such charges shall be deemed and are hereby declared to be delinquent, and thereafter such delinquencies shall constitute liens upon the real estate for which such services are supplied, and the Clerk is hereby authorized and directed to file sworn statements showing such delinquencies in the Office of the Recorder of Deeds of Mercer County, Illinois, and the filing of such statements shall be deemed notice for the payment of such charges for such service.    (D)   If the charges for water and sewerage service, or either of them, are not paid within thirty (30) days after the rendition of the bill for such services, then the water service shall be discontinued without further notice until all past due bills for either utility service are paid in full, together with payment of a fee pursuant to title 13, "Schedule Of Fees", of this Code.    (E)   It is hereby made the duty of the Clerk of the City to render bills for water and sewerage service, or either of them, and all other charges in connection therewith and to collect all monies due thereon.
   (F)   All revenues and monies derived from the operation of the combined waterworks and sewerage shall be held by the Clerk separate and apart from his private funds and separate and apart from all other funds of the City, and all of said sums, without any deductions whatsoever, shall be delivered to the City Treasurer not more than ten (10) days after the receipt of the same, or at such more frequent intervals as may from time to time be directed by the Council of the City.
   (G)   The City Treasurer shall receive all such revenues from the combined waterworks and sewerage system and all other funds and monies incident to the operation of said system, as the same may be delivered to him, and deposit the same in a separate fund, designated as the "Waterworks and Sewerage Fund of the City of Aledo", and said Treasurer shall administer said fund in every respect in the manner provided by "an act providing for the acquisition, construction, extension, improvement, maintenance and operation of a combined Municipal waterworks and sewerage system, the means of financing the same and in connection therewith the refunding of securities previously issued for any existing waterworks or sewerage system, or both, and the imposition and collection of charges and rates for the use thereof, in cities, villages and incorporated towns having a population of less than 500,000", approved May 15, 1934, as amended.
   (H)   Said City Treasurer shall establish a proper system of accounts and shall keep proper books, records and accounts, in which complete and correct entries shall be made of all transactions relative to the combined system, and at regular annual intervals the Council shall cause to be made an audit, by an independent auditing concern, of the books, to show the receipts and disbursements of the combined system.
