6-2-3-2: EXCEPTIONS:
   (A)   Upon a proper showing therefor, and upon due and convincing proof being made to the City Council of unique and unusual circumstances under which the strict enforcement of this chapter would result in extreme and peculiar hardship for the person involved, the Council may grant special permission to the person to do some act contrary to section 6-2-7, 6-2-8-1 or 6-2-8-4 of this chapter. The Council shall presume that such a hardship exists for any person who: 1) makes application for special permission under this subsection within ninety (90) days following passage of this chapter, and 2) provides proof that on the date of adoption hereof, and for a period of at least ninety (90) days prior thereto, such person either: a) maintained animals in apparent violation of section 6-2-7 of this chapter, b) owned more than six (6) cats or dogs in violation of section 6-2-8-1 of this chapter, or c) maintained a doghouse, shelter, kennel, dog run or other structure in violation of section 6-2-8-4 of this chapter.
   (B)   The granting of any special permission may be approved by the City Council only after a public hearing has been held by the Council.
   (C)   A legal notice shall be published at least one time in a newspaper of general circulation within the corporate limits of the City. The notice shall set forth the nature of the public hearing, the property involved and the date, time and place of the scheduled hearing, and shall be published at least five (5) calendar days prior to the hearing date.    (D)   Any request for special permission shall be accompanied by a fee pursuant to title 13, "Schedule Of Fees", of this Code. (Ord. 14/2017, 6-5-2017)
   (E)   In addition to the legal notice, the Aledo Police Department shall post a sign on the property for which special permission is being requested not less than five (5) calendar days prior to the hearing date. The sign shall give notice of the special permission being requested and the date, time and place of the scheduled hearing. (Ord. 8/2015, 10-19-2015, eff. 1-1-2016)
