3-15-10: ENFORCEMENT:
   (A)   Violation: The city of Aledo police department and its code officials are authorized to investigate and enforce the regulations of this chapter. In the event that such officials determine that a violation exists, such matter shall be brought before the city council for a hearing to determine: 1) the existence of a violation; 2) a determination that a "nuisance per se" exists, as defined herein; 3) if a violation or nuisance per se is declared by the council, an order of abatement shall immediately be issued. Abatement may include the closure of the building or premises that houses or accommodates the live sex act business.
   (B)   Order To Abate: The city attorney, in the name of the city of Aledo, upon direction by the city administrator or city council, may apply to a court of competent jurisdiction for an order permitting the city of Aledo to abate violations of this chapter. Abatement may include the closure of such building or premises housing or accommodating the live sex act business.
   (C)   Hearing: After notice to the operator of a live sex act business, the judge shall conduct a hearing and take evidence as to whether a live sex act business is being operated in violation of this chapter.
   (D)   Abatement: If, at the conclusion of the hearing, the judge determines that a live sex act business is being operated in the city of Aledo in violation of this chapter, an order shall be entered authorizing the city to abate the violation by closing the business. A copy of the order shall be delivered to the operator of the business and mailed to the owner of the property upon which the business is located.
   (E)   Remedies Not Exclusive: Nothing in this chapter shall prevent, restrain or otherwise preclude the city of Aledo from taking compliance measures other than those remedies as provided for above. The city may take other lawful measures, including, but not limited to, the issuance of ordinance citations and the arrest of parties found committing criminal offenses in conjunction with the enforcement of this chapter.
