3-15-7: OPERATION STANDARDS:
The operation of an "adult use", as defined herein, is subject to the following standards of operation:
   (A)   No portion of the adult use area shall be operated in an enclosed or partitioned area. All adult uses shall be conducted in a lawfully constructed and city code compliant building. No adult use shall be conducted in the open, in a temporary structure, trailer, motor home, tent or similar means of shelter.
   (B)   Private movie, video or other projection booths are prohibited.
   (C)   Adult stock, including movies, tapes, product covers containing specified sexual activities and specified anatomical areas shall not be disposed of in a manner that would allow access to these materials outside of the subject building by the general public.
   (D)   The hours of adult uses shall be no earlier than nine o'clock (9:00) A.M. and no later than ten o'clock (10:00) P.M., unless otherwise modified by the city council.
   (E)   Adult uses shall be in compliance with the adopted building, plumbing, mechanical and electrical codes of the city of Aledo, as well as the state of Illinois plumbing and life safety codes.
   (F)   As a condition of a special use permit, the adult use premises shall be open and available to city inspectors during the hours of operation and at any other reasonable hour for the purposes of inspection for fire safety and code compliance. Such inspections shall not be generated as a means to harass or unduly interfere with the operations of the use and shall have a verifiable public purpose.
   (G)   Live sex acts, as defined herein, are prohibited.
   (H)   No owner or operator of an adult use shall have been or shall be convicted of a crime involving kidnapping, prostitution, accosting or soliciting, pornography, child pornography, federal or state RICO or other organized crime laws, or other similar offenses.
   (I)   A violation of the standards of operations shall be prima facie evidence for the closure of such business for a period of time as provided for by the city council. No adult use shall be closed without a public hearing first being held by the city council, who shall consider evidence provided by law enforcement, code and other city officials, the general public and owners, operators and patrons of the subject use.
