3-4-6: FOOD SERVICE CARTS AND FOOD TRUCKS:
   (A)   No person shall engage in the operation of a food service cart or food truck within the city limits without first having obtained a certificate of registration.
   (B)   No food service cart or food truck shall operate on the public streets, medians, rights of way or in residentially zoned districts or in neighborhoods whose character is primarily residential.
   (C)   No food service cart or food truck shall operate in such a manner that presents a hazard, pedestrian or vehicular traffic impediment or hazard, and/or a threat to the health, safety or welfare of the public.
   (D)   No food service cart or food truck shall operate inside an enclosed building or structure unless such building or structure is approved for the specific use and occupancy by the city building official and complies with attendant codes, including, but not limited to, a certificate of occupancy. Food service cart or food truck purveyors are not precluded from selling their prepared wares through lawfully occupied and operating restaurants; provided, such activities comply with all state and county food safety regulations.
   (E)   The certificate of registration for a food service cart or food truck shall be accompanied by:
      1.   Proof that the applicant has registered or licensed with the state of Illinois department of revenue;
      2.   Proof that the license applicant has liability insurance in force for a minimum of one hundred thousand dollars ($100,000.00) per occurrence/three hundred thousand dollars ($300,000.00) aggregate;
      3.   Proof of food safety inspection approval from the Mercer County health department;
      4.   A copy of any required food safety license.
   (F)   No food service cart or food truck shall operate within the boundaries of a city sanctioned special event unless otherwise given written approval by the event licensee to operate within said boundaries. (Ord. 07/2015, 9-8-2015, eff. 1-1-2016)
