§ 130.27  SMOKING PROHIBITION IN VILLAGE HALL.
   (A)   Neb. RS 71-5716 through  71-5735, otherwise known as the State Clean Indoor Air Act, permit the regulation of smoking in public places to protect the public health, comfort and environment by prohibiting smoking in public places and at public meetings, except in designated smoking areas.
   (B)   The Village Board has determined it to be in the best interest of the public and the employees of the village to designate the entirety of the Village Hall a smoke-free environment and to prohibit smoking throughout such building (except maintenance area).
   (C)   Smoking is hereby prohibited throughout the entire building, except maintenance area, which comprises the Village Hall.
   (D)   In accordance with Neb. RS 71-5730, this prohibition does not apply in cases in which any room or the entire Village Hall is used for a private social function when seating arrangements are under the control of the sponsor of the function and not the Village Board or its employees.
   (E)   The Clerk of the village shall obtain and post at all entrances of the Village Hall, and at other conspicuous locations throughout the building, signs indicating that smoking is prohibited in the entire building.
   (F)   Any person failing to comply with the provisions of this nonsmoking designation shall be subject to prosecution for a Class V misdemeanor under the laws of the state in accordance with the provisions of the State Clean Air Act.
