§ 34.01 SMOKING POLICY.
   (A)   Smoking, as herein defined, is prohibited in certain local government buildings as provided in this section.
   (B)   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      LOCAL GOVERNMENT BUILDING. Any enclosed structure or room therein which is owned, leased, or controlled by the town, or any of its departments or agencies, and which is used or occupied for governmental purposes.
      SMOKING. The use of lighted tobacco in the form of a cigarette, cigar, or similar item, or a pipe or similar smoking equipment, by inhaling and exhaling the smoke of the tobacco, and includes the holding or carrying of these items when burning.
   (C)   Notwithstanding division (A) above, smoking shall be permitted in areas designated by the Town Council to be smoking areas.
   (D)   Any person smoking in a local government building who continues smoking after being asked to stop smoking shall be fined $25, provided, however, that the violation may be admitted and paid at the Ordinance Violation Bureau within 30 days from the commission of the violation, and in said case the fine upon admission shall be the sum of $10.
